Rental Update for July 2021

EPCs guidelines for 2025

  • The consultation is still in progress for improving energy efficiency in rental properties.
  • Recommendations and pressure from the Government’s commitment to improving our emissions by 2050 driving this decision.
  • We expect further news in the coming months but for now, we are advised to ensure Landlords are aware.
  • The recommendation is for all rental properties to be a Band C rating or above by 2025 for all new tenancies. Existing tenancies by 2028.

Advertising Properties Online

  • Consumer Protection Rights are broad and complicated, however, consumers are now being protected further under new proposed legislation whereby agents will be directed on how they present their marketing details when advertising properties.
  • A working group are piecing together guidelines and although it is still a work in progress our understanding is that agents MUST advertise what consumers need to know when making an informed decision to buy or rent a property.
  • Details must be honest, truthful, non-exaggerated, or contain misleading or omissible information.
  • As a minimum, the location, price, tenure (including the number of years remaining on leases) service charges/ground rent (if applicable) and accommodation type should be clearly available.
  • Penalties for misleading or omissible information could be up to £5,000 and/or 2 years imprisonment.

Update on Covid adjustments

  • Face coverings are recommended but are not a mandatory requirement.
  • Viewings and appraisals must not go ahead if there has been a positive lateral flow or PCR test, or if you have been contacted by track and trace.
  • Occupants of properties must give their approval for physical viewings. The message is to remain careful.
  • Evictions: at this stage, we are expecting changes at the end of September.
  • The current four-month requirement for notices returns to two months from 1st October with the exceptions as outlined previously.
  • Right to Rent virtual adjusted checks will end 31st August and return to physical checks from 1st September.
